Coypright Law and Contracts

When publishing in the Research Information System (=FIS) of the University of Bamberg, you must observe copyright law. As soon as you not only want to enter bibliographic data in the FIS, but also publish full texts, you will be asked to select a contract or complete the field “Copyright Best?tigung” (engl. “copyright confirmation”) – depending on the document type – and specify a licence.
The publication contract or copyright confirmation sets out the legal relationship between you, as the author, and the University. You grant the Bamberg University Library a simple, non-exclusive right to use your document. This means that, in line with a research-friendly rights policy, you retain all other rights of use.
The licence, on the other hand, sets out the terms of use for your published document. This allows you to decide how others may reuse the document. You can find further information about the licences on our website.
Granting of rights of use/publication contract for first publications
The grantings of rights of use / the publication contract regulate the legal relationship between you as the author and the Otto-Friedrich-University Bamberg, acting on its behalf the University Library Bamberg as the publisher. Your document cannot be published (i.e. made available in FIS) until the relevant signed form has been received by the University Library. If you are simply submitting a title entry for the university bibliography (without full text), no form is required.
The following grantings of rights to use eg. the publication contract of UBP can be offered for the document types book (monograph), dissertation, habilitation, bachelor's thesis / master's thesis / thesis, working paper:
- Publication (except theses)(102.1 KB): Please select this form for publications in the FIS that are neither published by the University of Bamberg Press nor are theses.
- Theses (dissertation, habilitation, Bachelor's thesis / Master's thesis / thesis)(113.5 KB): Please select this form if you would like to publish a thesis in the FIS. In addition to you, your supervisor must sign the form stating that he or she agrees to the publication.
- Publications in the publishing house UBP(210.0 KB): Please choose this contract if you would like to publish in the university publishing house University of Bamberg Press.
- Pre-confirmation according to §16 (3) PromO GuK and HuWi(134.8 KB): In the faculties GuK and HuWi the doctoral certificate can be handed out early under certain conditions. Please choose this form if you have completed your doctorate at one of the two faculties, would like to publish your dissertation elsewhere and need an early confirmation.
You are welcome to email the contract, signed by hand, to publizieren.ub(at)uni-bamberg.de. Alternatively, you may hand it in at any of our branch libraries for the attention of the Research and Publication Services Deparment, or post it to the following address:

For other types of document, such as conference objects or preprints, the rights of use are granted via the field “Copyright Best?tigung” (engl. “copyright confirmation”). A contract is not required in this case.
When publishing your work as a first publication, the choice of licence is entirely up to you as the author. In line with our open access policy, we recommend the Creative Commons licence CC BY.
Granting of rights of use for secondary publications
A secondary publication is generally only possible if the legal requirements are met. In addition, certain conditions must usually be complied with. You can find publishers’ standard policies on secondary publication in the research tool Open Policy Finder. You can also find further information on our website.
By completing the copyright confirmation form, you grant the Bamberg University Library a non-exclusive licence to use the material and confirm that this does not infringe the rights of any third parties.
The licence you can choose for secondary publication depends on the publisher’s guidelines. For example, some publishers do not allow the use of a Creative Commons licence. Publications that have already been published under a Creative Commons licence may be republished in FIS under the same licence. Further information on licences can be found on our website.
Copyright confirmation
By selecting "Ja" (engl. “Yes”) in the field “Copyright Best?tigung" (engl. ”copyright confirmation") on the submission form, you confirm the following regarding the uploaded document:
- The individuals listed hereby grant the Bamberg University Library a non-exclusive and permanent right to use the digital document for publication in the FIS. No other rights of use stand in the way of this transfer.
- The publication of this document and the third-party text and/or image material it contains does not infringe any third-party rights. The rights holders undertake to notify Bamberg University Library immediately in the event of any doubt or should any alleged or actual legal obstacles arise in this regard.
- The Bamberg University Library and the German National Library are authorised to store the document and the accompanying metadata, make them publicly available on data networks, and convert them into other data formats.
